A． Costs Estimate For Trade Marks Application in India (for simple straightforward application)

Ⅰ。SEARCH 查詢（Optional 非必須的）

a) Availability search-comprehensive report 綜合的查詢及報(bào)告 $2,500

(including instruction our associate/agent to conduct the search of the Trade Marks

Register, reviewing and reporting the search results with advice on registration)

申請(qǐng)前查詢的作用是找出類似或相同并對(duì)申請(qǐng)有影響的已申請(qǐng)/注冊(cè)的商標(biāo)。

此費(fèi)用包括在商標(biāo)注冊(cè)署進(jìn)行商標(biāo)查詢﹑分析和報(bào)告查詢結(jié)果以及提供建議。

Ⅱ.a) FILING OF APPLICATION, ADVERTISEMENT ®ISTRATION 申請(qǐng)費(fèi) 用 $5,000

(以一個(gè)商標(biāo)申請(qǐng)一個(gè)類別計(jì)算)

The fees includes professional service fees of classifying the goods or services, preparing the relevant application form, filing the application and reporting filing particulars.

此費(fèi)用包括商標(biāo)分類服務(wù)﹑準(zhǔn)備有關(guān)申請(qǐng)表格及文件﹑提出申請(qǐng)及報(bào)告申請(qǐng)進(jìn)度。

 

Ⅲ. MISC.(Additional Service Charges 額外服務(wù))

 

a) Drafting, Amending and Filing Arguments 草擬﹑修改及申辯費(fèi)用

(simple argument per case以每個(gè)簡(jiǎn)單的申辯計(jì)算) $3,000 -$10，000

The argument fees may be adjusted based on the complexity of the cases, Separate

quotation will be issued for cases involving court proceeding.

此費(fèi)用只限于一般申辯及會(huì)因案件的復(fù)雜程度而有所調(diào)整。另涉及法院程序的案件會(huì)根據(jù)個(gè)別律師的費(fèi)用而定，我方將會(huì)預(yù)先通知。

 

 

b) Renewal 續(xù)期 （for 10 years 有效期十年）

 

i) For one mark one class以一個(gè)商標(biāo)申請(qǐng)一個(gè)類別計(jì)算 （10 items 10項(xiàng)目）

B． Procedure for applying trade mark registration 商標(biāo)注冊(cè)申請(qǐng)的程序

 

Ⅰ.A word, logo or both, which is distinctive, can be applied for trademark registration.

任何具顯著性的文字﹑圖案或文字加圖案的標(biāo)記均可申請(qǐng)注冊(cè)。

 

Ⅱ. An availability search is usually recommended to find out whether there is any similar or identical filed/registered marks which may bar your application. After the search, the filing of the mark will be applied in the specified class with up to 10 designed goods or services. There are totally 45 classes. The fees for trademark application is for 10 years and the trademark could be renewed every 10 years.

申請(qǐng)前查詢的作用是找出類似或相同并對(duì)申請(qǐng)有影響的已申請(qǐng)/注冊(cè)的商標(biāo)。查詢后再分類為最多十項(xiàng)指定物品或服務(wù)，總共有45類。費(fèi)用為有效期十年。之后可在到期日或之前，續(xù)期十年。

 

Ⅲ. After the filing of the application, the Registry will examine the mark in the application. If the application fulfills the requirement, then the application will be granted by the examiner and the Registry will require the applicant to advertise the trademark. If no opposition to the application is filed in 2 months time, the Registry will grant the application and issue the certificate. The time span from filing to obtaining a trademark will normally take approximately 12-15 months.

提交申請(qǐng)后，商標(biāo)注冊(cè)署審查員會(huì)對(duì)申請(qǐng)作出審查。如申請(qǐng)合乎商標(biāo)法條例及沒(méi)有抵觸其他注冊(cè)或已申請(qǐng)注冊(cè)的商標(biāo)，注冊(cè)署會(huì)發(fā)出公告許可證及列明商標(biāo)獲準(zhǔn)注冊(cè)所須遵辦的條件。如在公告日期起計(jì)之2個(gè)月內(nèi)沒(méi)有人提出反對(duì)，申請(qǐng)人將于12至15個(gè)月后便可申領(lǐng)注冊(cè)證書(shū)。
